Delta Tau Delta special license plates, application, fee.
301.3143. 1. Any current member or alumnus of the Delta Tau Deltaorganization at any college or university within this state may apply forspecial motor vehicle license plates for any vehicle such person owns,either solely or jointly, other than an apportioned motor vehicle or acommercial motor vehicle licensed in excess of eighteen thousand poundsgross weight, after an annual payment of an emblem-use authorization fee tothe appropriate organization. Delta Tau Delta hereby authorizes the use oftheir official emblem to be affixed on multiyear personalized licenseplates as provided in this section. Any contribution to Delta Tau Deltaderived from this section, except reasonable administrative costs, shall beused solely for the purposes of the organization. Any member of Delta TauDelta may annually apply for the use of the organization's emblem.
2. Upon annual application and payment of a twenty-five dollaremblem-use contribution to Delta Tau Delta, the organization shall issue tothe vehicle owner, without further charge, an emblem-use authorizationstatement, which shall be presented by the owner to the department ofrevenue at the time of registration of a motor vehicle. Upon presentationof the annual statement, payment of a fifteen dollar fee in addition to theregistration fee, and documents which may be required by law, thedepartment of revenue shall issue to the vehicle owner a personalizedlicense plate which shall bear the emblem of Delta Tau Delta and shall bearthe words "DELTA TAU DELTA" in place of the words "SHOW-ME STATE". Suchlicense plates shall be made with fully reflective material with a commoncolor scheme and design, shall be clearly visible at night, and shall beaesthetically attractive, as prescribed by section 301.130.Notwithstanding the provisions of section 301.144, no additional fee shallbe charged for the personalization of license plates pursuant to thissection.
3. A vehicle owner, who was previously issued a plate with the DeltaTau Delta emblem authorized by this section but who does not provide anemblem-use authorization statement at a subsequent time of registration,shall be issued a new plate which does not bear the Delta Tau Delta emblem,as otherwise provided by law. The director of revenue shall make necessaryrules and regulations for the administration of this section, and shalldesign all necessary forms required by this section. Any rule or portionof a rule, as that term is defined in section 536.010, RSMo, that iscreated under the authority delegated in this section shall becomeeffective only if it complies with and is subject to all of the provisionsof chapter 536, RSMo, and, if applicable, section 536.028, RSMo. Thissection and chapter 536, RSMo, are nonseverable and if any of the powersvested with the general assembly pursuant to chapter 536, RSMo, to review,to delay the effective date, or to disapprove and annul a rule aresubsequently held unconstitutional, then the grant of rulemaking authorityand any rule proposed or adopted after August 28, 2004, shall be invalidand void.
