Fight Terrorism special license plates, application, contributionrequirement--fee--rules authorized.
301.3123. 1. Any vehicle owner may apply for "FIGHT TERRORISM"license plates for any motor vehicle the person owns, either solely orjointly, other than an apportioned motor vehicle or a commercial motorvehicle licensed in excess of eighteen thousand pounds gross weight. Uponmaking an annual twenty-five dollar contribution to the antiterrorism fundestablished pursuant to section 41.033, RSMo, the vehicle owner may applyfor the "FIGHT TERRORISM" plate. If the contribution is made directly tothe Missouri office of homeland security it shall issue the individualmaking the contribution a receipt, verifying the contribution, that may beused to apply for the "FIGHT TERRORISM" license plate. If the contributionis made directly to the director of revenue pursuant to section 301.3031,the director shall note the contribution and the owner may then apply forthe "FIGHT TERRORISM" plate. The applicant for such plate must pay afifteen dollar fee in addition to the regular registration fees and presentany other documentation required by law for each set of "FIGHT TERRORISM"plates issued pursuant to this section. Notwithstanding the provisions ofsection 301.144, no additional fee shall be charged for the personalizationof license plates issued pursuant to this section. The "FIGHT TERRORISM"plate shall bear an emblem prescribed by the director of revenue and shallhave the words "FIGHT TERRORISM" in place of the words "SHOW-ME STATE".The insignia shall be affixed on multiyear personalized license plateswithin the plate area prescribed by the director of revenue. Such licenseplates shall be made with fully reflective material with a common colorscheme and design of the standard license plate, shall be clearly visibleat night, shall have a reflective white background in the area of the plateconfiguration, and shall be aesthetically attractive, as prescribed bysection 301.130.
2. A vehicle owner, who was previously issued a "FIGHT TERRORISM"license plate authorized by this section but who does not provide proof ofthe annual contribution at a subsequent time of registration, shall beissued a new plate which does not bear the emblem or motto "FIGHTTERRORISM", as otherwise provided by law.
3. The director of revenue may promulgate rules and regulations forthe administration of this section, and shall design all necessary formsrequired by this section. Any rule or portion of a rule, as that term isdefined in section 536.010, RSMo, that is created under the authoritydelegated in this section shall become effective only if it complies withand is subject to all of the provisions of chapter 536, RSMo, and, ifapplicable, section 536.028, RSMo. This section and chapter 536, RSMo, arenonseverable and if any of the powers vested with the general assemblypursuant to chapter 536, RSMo, to review, to delay the effective date or todisapprove and annul a rule are subsequently held unconstitutional, thenthe grant of rulemaking authority and any rule proposed or adopted afterAugust 28, 2003, shall be invalid and void.
