Inspection of hoisting equipment, records--penalty (coal mines).

293.360. 1. Every owner or operator, or the agent of suchowner or operator of any coal mine in this state, who shallemploy twenty-five or more miners or mine laborers, where anymechanical device is or shall be used for the lowering orhoisting of men into or out of such mine, shall have someexperienced practical person to inspect all ropes, cages, safetycatches, shive wheels and drum brakes at least twice in each weekwhile such mine shall be in operation. And every such owner oroperator, or the agent of such owner or operator of such mine, ishereby required to furnish a book of suitable kind in which theresults of each inspection are hereby required to be entered andrecorded by the person making such inspection as soon and asoften as the same shall be made, always reciting in such bookalso the day and date of such inspection; and such book shall bekept at such mine, and shall, on all working days, be open forthe information of all employees of such mine.

2. Every owner or operator, or the agent of such owner oroperator of any coal mine in this state of the kind mentioned insubsection 1, who shall fail to comply with the provisions ofsaid subsection, shall be deemed guilty of a misdemeanor, and,upon conviction thereof, shall be punished by a fine of not lessthan twenty-five dollars nor more than one hundred dollars, or byimprisonment in the county jail not less than thirty days normore than ninety days, or by both such fine and imprisonment foreach and every separate offense. And every failure to have madesuch inspection and to have entered and recorded the results ofsuch inspection as provided in subsection 1 on any day when thesame should have been done, shall constitute a separate offense.
