Insurers to file rate information in competitive market with thedirector, purpose--noncompetitive market, information filed--form offiling--public inspection.
287.947. 1. In a competitive market, every insurer shallfile with the director all rates and supplementary rateinformation which is to be used in this state, except as providedin section 287.955. Such rates and supplementary rateinformation shall be filed not later than thirty days after theeffective date. If the director finds, after a hearing, that aninsurer's rates require closer supervision because of theinsurer's financial condition or unfairly discriminatory ratingpractices, the insurer shall file with the director at leastthirty days before the effective date, all such rates and suchsupplementary rate information and supporting information asprescribed by the director. Upon application by the filer, thedirector may authorize an earlier effective date.
2. In a noncompetitive market every insurer shall file withthe director all rates and supplementary rate information whichis to be used in this state, except as provided in section287.942. Such rates and supplementary rate information andsupporting information required by the director shall be filed atleast thirty days before the effective date. Upon application bythe filer, the director may authorize an earlier effective date.
3. Rates filed pursuant to this section shall be filed insuch form and manner as prescribed by the director. In anoncompetitive market, whenever a filing is not accompanied bysuch information as the director has required under this section,the director shall so inform the insurer within fifteen days andthe filing shall not be deemed to be made until the informationis furnished or the insurer certifies that the additionalinformation is not maintained or cannot be provided.
4. All rates, supplementary rate information and anysupporting information for risks filed under sections 287.930 to287.975 shall, as soon as filed, be open to public inspection atany reasonable time. Copies may be obtained by any person onrequest and upon payment of a reasonable charge.
