Inspection, limitations--search warrant may be issued,when--violations, prosecuting attorney's duties.
281.270. 1. For the purpose of enforcing the provisions ofsections 281.210 to 281.310 the director may, with permissionfrom the owner or person in charge, enter upon any businesspremises at reasonable times in order to inspect, investigate,observe, and sample; provided, that, such right of entry, in thecase of manufacturing and formulation establishments, be limitedto those areas where records are maintained and pesticides arepackaged, labeled and released for shipment.
2. If the director is denied access to any land or buildingswhere such access was sought for the purposes set forth in thissection, he may apply to any court of competent jurisdiction fora search warrant authorizing access to that land or building forthose purposes. The court may issue a search warrant for thepurposes requested upon probable cause being shown.
3. The director may report any violation of the provisionsof sections 281.210 to 281.310 to the prosecuting attorney of thecounty where the violation occurs. The prosecuting attorney mayinstitute civil proceedings in a court of competent jurisdiction.If any prosecuting attorney refuses or fails to act on request ofthe director, the attorney general shall so act.
