281.060. 1. The director, after inquiry, and afteropportunity for a hearing, may deny, suspend, revoke, or modifythe provisions of any license, permit, or certification issuedunder sections 281.010 to 281.115, if he finds that the applicantor the holder of a license, permit, or certification has violatedany provision of sections 281.010 to 281.115, or any regulationissued thereunder, or has been convicted or subject to a finalorder imposing a civil or criminal penalty pursuant to theFederal Insecticide, Fungicide and Rodenticide Act (FIFRA), asamended, or has been convicted, or is the subject of prosecution,in another state or protectorate of the United States, or has hada pesticide applicator license, certificate or permit denied,suspended, revoked or modified by another state or protectorateof the United States, or the person has been finally adjudicatedand found guilty, or entered a plea of guilty or nolo contendere,in a criminal prosecution under the laws of any state or of theUnited States, for any offense reasonably related to thequalifications, functions or duties of any profession licensed orregulated under this chapter, for any offense an essentialelement of which is fraud, dishonesty or an act of violence, orfor any offense involving moral turpitude, whether or notsentence is imposed.

2. If the director determines, after inquiry and opportunityfor a hearing, that any individual is in violation of anyprovision of sections 281.010 to 281.115, or any regulationsissued thereunder, the director shall have the authority toassess a civil penalty of not more than one thousand dollars foreach violation, and in addition, may order that restitution bemade to any person.

3. In the event that a person penalized or ordered to payrestitution under this section fails to pay the penalty orrestitution, the director may apply to the circuit court of ColeCounty for, and the court is authorized to enter, an orderenforcing the assessed penalty or restitution.
