Plans to be submitted, contents of--disapproval, effect of.
260.220. 1. Except as otherwise provided by subsection 4 ofsection 260.215, on or before January 1, 1976, each county andcity shall submit to the department an officially adopted planfor a solid waste management system or systems serving areaswithin its jurisdiction and shall, from time to time, submit eachsuch revision of said plan as it deems necessary or as thedepartment may require, but this provision shall not prohibitcities and counties to contract as provided in chapter 70, RSMo,for development and submission of a joint plan or to authorizetheir respective regional planning commission to develop andsubmit the required plan.
2. Every plan shall:
(1) Delineate areas within the jurisdiction of the politicalsubdivision where solid waste management systems are in existenceand areas where the solid waste management systems are planned tobe available within a ten-year period;
(2) Reasonably conform to the rules and regulations adoptedby the department for implementation of sections 260.200 to260.245;
(3) Provide for the orderly extension of solid wastemanagement systems in a manner consistent with the needs andplans of the whole area, and in a manner which will minimizepollution of the waters or air of the state, prevent publicnuisances or health hazards and shall otherwise provide for thesafe and sanitary disposal of solid waste;
(4) Take into consideration existing comprehensive plans,population trend projections, engineering and economics so as todelineate with practicable precision those portions of the areawhich may reasonably be expected to be served by a solid wastemanagement system;
(5) Take into consideration existing acts and regulationsaffecting the development, use and protection of air, water orland resources;
(6) Establish a time schedule and proposed method offinancing for the development, construction and operation of theplanned solid waste management systems together with theestimated cost thereof; and
(7) Include such other reasonable information as thedepartment shall require.
3. The plan shall be reviewed by appropriate officialplanning agencies within the area covered by the plan forconsistency with programs of comprehensive planning for the area,and all such reviews shall be transmitted to the department withthe proposed plan.
4. In the event any plan or part thereof is disapproved, thedepartment shall furnish any and all reasons for suchdisapproval, and any city, county, or regional planningcommission whose plan is disapproved shall within sixty daysrevise and resubmit the plan for approval or may request ahearing in accordance with section 260.235.
5. The department may provide technical assistance tocounties, cities, and regional planning commissions incoordinating plans for solid waste management systems required bysections 260.200 to 260.245, including revisions of such plans.
6. The director may institute appropriate action undersection 260.230 to compel submission of plans in accordance withsections 260.200 to 260.245 and the rules and regulations adoptedpursuant to sections 260.200 to 260.245.
