259.200. 1. Any person who violates any provision of thischapter, or any rule, regulation, or order of the council shallbe subject to a penalty of not more than one thousand dollars foreach act of violation and for each day that such violationcontinues, unless the penalty for such violation is otherwisespecifically provided for and made exclusive in this chapter.

2. If any person, for the purpose of evading this chapter,or any rule, regulation, or order of the council, shall make orcause to be made any false entry or statement in a reportrequired by this chapter or by any such rule, regulation, ororder, or shall make or cause to be made any false entry in anyrecord, account, or memorandum required by this chapter, or byany such rule, regulation, or order, or shall omit, or cause tobe omitted, from any such record, account, or memorandum, full,true, and correct entries as required by this chapter, or by anysuch rule, regulation, or order, or shall remove from this stateor destroy, mutilate, alter or falsify any such record, account,or memorandum, such person shall be guilty of a misdemeanor andupon conviction shall be punished as provided by law.

3. Any person knowingly aiding or abetting any other personin the violation of any provision of this chapter, or any rule,regulation, or order of the council shall be subject to the samepenalty as that prescribed by this chapter for the violation bysuch other person.

4. The penalties provided in this section shall berecoverable by suit filed by the attorney general in the name andon behalf of the council, in the circuit court of the county inwhich the defendant resides, or in which any defendant resides,if there be more than one defendant, or in the circuit court ofany county in which the violation occurred. The payment of anysuch penalty shall not operate to legalize any illegal oil,illegal gas, or illegal product involved in the violation forwhich the penalty is imposed, or to relieve a person on whom thepenalty is imposed from liability to any other person for damagesarising out of such violation.
