Department official state planning agency--powers and duties.
251.170. 1. The office of administration is herebydesignated as the official state planning agency for the purposeof providing planning assistance to counties, municipalities,metropolitan planning areas, and regional planning commissionsherein created when requested by such local governmental unit orplanning commission to do so, and for such purposes is authorizedto:
(1) Contract with public agencies or private persons ororganizations for any purposes of sections 251.010 to 251.440;
(2) Delegate any of its functions to any other state agencyauthorized to perform such functions, except that responsibilityfor such functions shall remain solely with the state office;
(3) Require or receive reimbursement from any politicalsubdivision or subdivisions or regional planning commissions forthe actual cost of planning assistance or planning work, whensuch assistance or planning has been requested by the politicalsubdivision or commission; except that, no reimbursement shall berequired or received for such costs to the extent that such costsare covered by federal grants.
2. From all regional planning commissions to which itprovides planning assistance pursuant to this section, the officeof administration shall gather information to identifyexpenditures of such commissions which are or would be eligibleto be used to generate matching funds under block grant programs,including but not limited to community development block grantprograms. The office of administration shall report any suchexpenditures which are so eligible to the department of economicdevelopment within thirty days of determining that suchexpenditures are so eligible. The department of economicdevelopment shall provide the office of administration withinformation deemed necessary by the commissioner ofadministration to implement the provisions of this subsection.For any fiscal year in which a regional planning commission whichreceives planning assistance from the office of administrationdoes not provide the office of administration with informationnecessary to implement the provisions of this subsection, theoffice of administration shall not distribute general revenuefunds to that regional planning commission in the followingfiscal year. Any regional planning authority shall have thirtydays to cure any alleged defect prior to the withholding of anyfunds.
