Penalties.
236.500. 1. Any person who willfully violates any of theprovisions of sections 236.400 to 236.500 is guilty of amisdemeanor and, upon conviction, shall be punished by a fine ofnot less than five hundred dollars nor more than ten thousanddollars, or by confinement in the county jail for a term of notless than thirty days nor more than one year, or by both suchfine and confinement.
2. In the event of a continuing violation, each day that theviolation continues shall constitute a separate and distinctoffense.
3. Any person who willfully obstructs, hinders or preventsthe council, the chief engineer or his agents or employees fromperforming the duties imposed by sections 236.400 to 236.500 andrules and regulations promulgated hereunder or who willfullyresists the council, the chief engineer or his agents in theperformance of the duties imposed on them by sections 236.400 to236.500 and rules and regulations promulgated hereunder is guiltyof a misdemeanor and, upon conviction, shall be punished asprovided in subsection 1 of this section.
4. Any owner who willfully engages in the construction,repair, alteration or removal of any dam or reservoir without aconstruction permit or in violation of a construction permit orwillfully violates the requirements of or for a safety orregistration permit is guilty of a misdemeanor and, uponconviction, shall be punished as provided in subsection 1 of thissection.
