Extension of workers' compensation law to include employees of statehighways and transportation commission and state highwaypatrol--self-insurance plans, when.
226.160. 1. The provisions of chapter 287, RSMo, governingworkers' compensation may be extended to include the employees ofthe state highways and transportation commission and theemployees of the state highway patrol as herein provided. Thestate highways and transportation commission shall have authorityby resolution to elect, under the provisions of section 287.030,RSMo, to accept the provisions of chapter 287, RSMo, and to paycompensation to its employees and to the uniformed members of thestate highway patrol, for injury or death arising out of and inthe course of their employment in accordance with the provisionsand restrictions as set forth in chapter 287, RSMo. The statehighways and transportation commission shall adopt rulesclassifying the employees who may be eligible for compensationunder this section and section 226.170 and its classificationshall be decisive as to whether or not an employee falls withinthe definition of an employee eligible for compensation coverageunder this section and section 226.170. In case the commissionshall elect to accept such provisions, it may purchase insurancefor such purpose or establish a self-insurance plan pursuant tothe provisions of chapter 287, RSMo. The commission shall haveauthority to perform such other duties as may be necessary orincidental effectually to carry out the purposes of this law.
2. If the commission decides to establish a self-insuranceplan, the commission shall annually determine the amount ofcontribution to the plan required to pay all accrued andanticipated claims and the cost of administering the plan, andshall include such amount in its budget request for contributionto the highways and transportation commission employees' andhighway patrol workers' compensation fund. The commission maycontract for the services of such actuaries, consultants andclaims administrators as it deems necessary for the effectiveadministration of a self-insurance plan, and is authorized tocontract for excess insurance coverage with an insurance companyauthorized to write such coverage in this state.
