208.461. 1. Each federal reimbursement allowanceassessment shall be final, unless the hospital files a protestwith the director of the department of social services settingforth the grounds on which the protest is based, within thirtydays from the date of notice by the department of social servicesto the hospital.
2. If a timely protest is filed, the director of thedepartment of social services shall reconsider the assessmentand, if the hospital has so requested, the director shall grantthe hospital a hearing within ninety days after the protest isfiled, unless extended by agreement between the hospital and thedirector. The director shall issue a final decision within sixtydays of completion of the hearing. After reconsideration of theassessment and a final decision by the director of the departmentof social services, a hospital's appeal of the director's finaldecision shall be to the administrative hearing commission inaccordance with sections 208.156 and 621.055, RSMo.
