Pilot projects authorized, where--definitions.
208.309. 1. Sections 208.309 to 208.315 shall be known as the "EldersVolunteer for Elders Project (EVE) Act". Subject to appropriations, thedepartment of social services, division of aging, shall review applicationsand award grants to at least three community provider organizations for theprovisions of services which shall establish a three-year demonstrationproject designed to prevent the premature or unnecessary institutionalizationof Missouri's low-income elderly citizens in specifically definedneighborhoods located in a city not within a county, a city with a populationof more than three hundred fifty thousand inhabitants which is located in morethan one county and in region 2 of the Missouri area agencies on aging.
2. As used in sections 208.309 to 208.315, the following terms mean:
(1) "Community provider organizations", any:
(a) Charitable organization as defined in section 407.453, RSMo;
(b) Not-for-profit corporation established pursuant to chapter 355,RSMo; or
(c) An organization that has obtained an exemption from the payment offederal income taxes as provided in section 501(c)(3), 501(c)(7) or 501(c)(8)of Title 26, U.S.C., as amended;
(2) "Division", division of aging of the department of social services;
(3) "Elderly low-income person", a Missouri citizen who is sixty yearsof age or older and whose income is at or below one hundred fifty percent ofthe federal poverty level;
(4) "Project", a demonstration project directed at Missouri's low-incomeelderly who are at risk of involuntary and unnecessary institutionalization;
(5) "Recipient", any elderly low-income person who is in need ofassistance with at least one of the activities of daily life or assistancewith instrumental activities of daily living. The highest priority will begiven to those at risk of incapacity adjudication.
