Attorney's fees to be paid by department for recipient appeals forfederal supplemental security income benefits, when--rules,procedure.
208.216. 1. The department of social services shall makedisbursements to any attorney who represented a recipient ofgeneral relief under this chapter in an appeal of any claim forfederal supplemental security income benefits before anadministrative law judge which is decided in favor of suchrecipient. The amount of such disbursement shall not exceedtwenty-five percent of the maximum federal supplemental securityincome grant payable to an individual for a period of one year.No such disbursement shall be made unless a petition and a copyof the favorable decision is submitted by such attorney to thedepartment of social services within sixty days of the date ofsuch decision. The disbursement shall be made within thirty daysafter the petition is received.
2. The department of social services shall promulgate rulesand regulations necessary to implement the provisions of thissection, pursuant to the provisions of section 208.151 andchapter 536, RSMo.
