Monthly benefits, how determined.
208.150. The maximum amount of monthly public assistancemoney payment benefits payable to or on behalf of a needy personshall not exceed the following:
(1) Aid to families with a dependent child, or children,and needy eligible relatives caring for a dependent child, orchildren, in an amount to be computed as follows:
(a) Beginning July 1, 1993, and at least every three yearsthereafter, the division of family services shall determine byregulation the average need for each such eligible person, whichshall include the cost of basic needs required to maintain achild or children in the home at a reasonable and decentlow-income standard of living, and shall pay, on a uniform basis,the highest percent of such need as shall be possible within thelimits of funds appropriated for that purpose, less availableincome;
(b) "Available income" means the total income, before taxesor other deductions, of each person residing within the samehousehold, except, to the extent allowed by federal law, theearnings of a student under nineteen years of age enrolled in asecondary school or at the equivalent level of vocational ortechnical training, plus or minus such credits or deductions asmay be prescribed by the division of family services byregulations for the sole purpose of complying with federal lawsor regulations relating to this state's eligibility to receivefederal funds for aid to families with dependent childrenpayments, and such credits or deductions as may otherwise beprescribed by law;
(c) The available income shall be subtracted from the totalamount which otherwise would be paid;
(d) If the determined need under this subdivision is of anamount less than ten dollars, no cash payment will be made;
(2) Aid or public relief to an unemployable person not toexceed one hundred dollars.
