208.001. 1. 2. In Missouri, the medical assistance program on behalf of needypersons, Title XIX, Public Law 89-97, 1965 amendments to the federal SocialSecurity Act, 42 U.S.C. Section 301, et seq., shall be known as "MOHealthNet". Medicaid shall also mean "MO HealthNet" wherever it appearsthroughout Missouri Revised Statutes. The title "division of medicalservices" shall also mean "MO HealthNet division".
3. The MO HealthNet division is authorized to promulgate rules,including emergency rules if necessary, to implement the provisions of theMissouri continuing health improvement act, including but not limited tothe form and content of any documents required to be filed under such act.
4. Any rule or portion of a rule, as that term is defined in section536.010, RSMo, that is created under the authority delegated in theMissouri continuing health improvement act, shall become effective only ifit complies with and is subject to all of the provisions of chapter 536,RSMo, and, if applicable, section 536.028, RSMo. This section and chapter536, RSMo, are nonseverable and if any of the powers vested with thegeneral assembly pursuant to chapter 536, RSMo, to review, to delay theeffective date, or to disapprove and annul a rule are subsequently heldunconstitutional, then the grant of rulemaking authority and any ruleproposed or adopted after August 28, 2007, shall be invalid and void.
