Real property, obligations, rights of nine-director urban schooldistrict used solely for library purposes transferred to urban publiclibrary district--property used for both library and nonlibrarypurposes not to be transferred--rental agreement, when.

182.721. 1. Except as otherwise provided in subsections 2and 3 of this section, on the effective date of the creation ofan urban public library district pursuant to sections 182.701 to182.723, all right, title and interest of a nine-director urbanschool district in and to all real property and improvementsthereon used for public library purposes or thereafter acquiredfor public library purposes shall be transferred to and vested inthe urban public library district the boundaries of whichcoincide with those of the nine director urban school district.

2. Any real property held by a nine-director urban schooldistrict which was formerly used for nonlibrary purposes, andwhich at the time of the election resulting in creation of anurban public library district had a building constructed thereonused for public library purposes with a postal facility in thebuilding, shall become the property of the new urban publiclibrary district.

3. Any real property or improvements thereon or both whichwere acquired, built or developed with funds raised or providedfor, or otherwise dedicated to, both library purposes andnonlibrary purposes shall be retained by the nine-director urbanschool district. If any urban public library district elects tocontinue to occupy and use that building space used for publiclibrary purposes on the real property following creation of theurban public library district, the urban public library districtshall make such rental payments as are agreed upon by the urbanschool district and the urban public library district. The urbanschool district shall not be required to permit such use, whichshall occur only through a duly authorized and executed leaseagreement.

4. In addition to the transfer of any fee simple rights toproperty which was used solely for public library purposes as ofthe date of creation of the urban public library district, theurban school district serving the area shall transfer to the newurban public library district any and all reversionary rights,leasehold rights or other real property rights or obligations,including the obligation to make rental payments, which pertainto property used solely for public library purposes, except asotherwise provided for this section.
