Taxes raised for a library district transferred to successor urbandistrict, when--tax levy authorized, rate--rate increase,procedure--additional tax to erect buildings, procedure, ballotform.

182.715. 1. Whenever an urban public library district iscreated pursuant to section 182.703, the vote for creation of theurban public library district shall provide that any levy forlibrary purposes established pursuant to section 137.030, RSMo,shall be transferred to the urban public library district andsuch urban public library district shall be authorized to levy atax at this established levy rate. Any increase above this levyrate shall, on resolution adopted by the board of trustees of theurban public library district, be submitted to the voters of theurban public library district for approval, in accordance withthe provisions of section 137.030, RSMo.

2. If a majority of all the votes cast on the question shallbe for the tax increase as submitted, the increased tax specifiedin the notice shall be levied and collected in like manner withother county taxes and shall be paid and forwarded to thetreasurer of the board of trustees of an urban public librarydistrict by the county collector.

3. If a majority of the votes cast on the question shall beagainst the tax rate as submitted, then the tax rate shall remainat the previously existing levy.

4. Whenever in any urban public library district which hasdecided to establish and maintain a free library in any districtserved under the provisions of sections 182.701 to 182.723, theurban public library district board of trustees, by writtenresolution entered of record, deems it necessary that freelibrary buildings be erected in the district it shall notify theappropriate election authorities that the question should besubmitted to the voters of the urban public library district.The resolution and the notice shall specify the rate of taxationnecessary.

5. The question shall be submitted in substantially thefollowing form:

Shall there be a ................... cent tax for erection oflibrary buildings?

6. If the majority of the voters of the urban public librarydistrict voting on the question vote in favor of the tax, the taxspecified in the notice shall be levied and collected in likemanner with other taxes of the district, and delivered to thetreasurer of the board of trustees of the urban public librarydistrict, and shall be subject to the exclusive control of theurban public library district board of trustees and the fundshall be disbursed by the urban public library district treasureronly upon proper instrument of payment of the board of trustees,and be used for expenses incident to the erection and furnishingof the library buildings. The levy herein providing for theerection of library buildings shall be in addition to the taxlevied for the establishment and maintenance of the urban publiclibrary district.
