182.100. 1. Whenever, in any county library district which has decidedor shall hereafter decide to establish and maintain a free county libraryunder the provisions of sections 182.010 to 182.120, the county library boardof trustees, by written resolution entered of record, deems it necessary thatfree county library buildings be erected in the county and voters equal tofive percent of the total vote cast for governor at the last election of anycounty library district shall petition the county governing body in writingasking that an annual tax be levied at and as an increased rate of taxationfor the library buildings and specify in their petition a rate of taxationannually, and not to be levied for more than ten years, on all taxableproperty in such county library district, then the county governing body, ifit finds the petition was signed by the requisite number of voters, shallenter of record a brief recital of the petition, and of its finding, and shallorder that the question of the petition be submitted to the voters of thecounty library district at an election. The order and the notice shallspecify the rate of taxation mentioned in the petition.
2. The question shall be submitted in substantially the following form:
Shall there be a tax of ............... (insert amount) on each onehundred dollars assessed valuation for the erection of a free county librarybuilding?
3. If the majority of the voters of the county library district votingon the question vote in favor of the tax, the tax specified in the noticeshall be levied and collected in like manner with other taxes of the countylibrary district, and shall be known as the "County Library Building Fund",and shall be subject to the exclusive control of the county library board oftrustees. At least once in every month the county collector in all countiesof the first and second classes, including such counties having a charter formof government, shall pay over to the treasurer of the county library districtall money received and collected by him for the fund and take duplicatereceipts from the treasurer, one of which he shall file with the secretary ofthe county library district and the other he shall file in his settlement withthe county governing body. The county collector in counties of the third andfourth classes shall pay over to the county treasurer, at least once in everymonth, all moneys received and collected by him for the county librarybuilding fund and shall take duplicate receipts therefor, one of which heshall file in his settlement with the county governing body. The countytreasurer in such county shall pay over to the treasurer of the county librarydistrict, at least once in every month, all moneys so received by him for thefund; upon payment he shall take duplicate receipts from the treasurer of thecounty library district, one of which he shall file with the secretary of thedistrict, and the other he shall file in the settlement with the countygoverning body. This fund shall be used for expenses incident to the erectionand furnishing of the library building. The tax hereby provided for theerection of free county library buildings in such county shall be in additionto the tax levied for the establishment and maintenance of such countylibrary.
