173.555. 1. Moneys from the applied projects fund shall beused to defray a maximum of fifty percent or, for small business,a maximum of sixty-six and two-thirds percent of the expensesassociated with any applied project approved by the departmentfor funding under sections 173.500 to 173.565, provided that theremaining fifty percent or, for small business, the remainingthirty-three and one-third percent of the expenses associatedwith any such project is contributed by or through sources otherthan the state or federal government. The department shallapprove for funding only those applied projects for which:

(1) Contributions were not committed for the same or relatedapplied projects prior to August 13, 1982;

(2) Contributions have been obtained from sources other thanthe state or federal governments, student fees, institutionalendowment or other moneys used to fund the operating budget ofany institution;

(3) Enhanced employment opportunity within this state willlikely result; and

(4) Funding of the project is otherwise consistent with thepurposes of sections 173.500 and 173.545 to 173.565.

2. Only those expenses which are usually and customarilyattendant to academic research shall be provided, including,without limitations, salaries of principal directors andassistants and the purchase of equipment and supplies. Moneys inthe applied projects fund shall in no event be used to defraycosts normally attributed to institutional overhead. Thechargeability of any disputed item shall be determined by thedepartment, and decisions of the department with respect toselection of applied projects shall be final.
