Indemnification permitted, when--insurance or indemnity policiesauthorized.

169.750. 1. To the extent determined appropriate by the board oftrustees, the retirement systems established under sections 169.020 and169.610 may indemnify and protect any trustee or employee of the retirementsystem against any or all claims or liabilities, including defense thereof,arising out of his or her responsibilities with respect to the retirementsystem provided, however, that no trustee or employee shall be indemnifiedfor his or her own gross negligence or willful misconduct. This sectionshall apply whether the claim is made against the employee or trustee inhis or her individual or official capacity.

2. The board of trustees is authorized to obtain and maintaininsurance or indemnity policies to insure the trustees and employees of theretirement system against any liability or losses incurred as a result oftheir responsibilities with respect to the retirement system.

3. No employee or trustee shall be entitled to indemnification underthis section unless within fifteen days after receipt of service of processhe or she shall give written notice of such proceeding to the board oftrustees.
