Rules, invalid, when.
166.445. Any rule or portion of a rule, as that term is defined insection 536.010, RSMo, that is promulgated under the authority delegated insections 166.400 to 166.455 shall become effective only if it has beenpromulgated pursuant to the provisions of chapter 536, RSMo. Allrulemaking authority delegated prior to August 28, 1998, is of no force andeffect and repealed; however, nothing in this section shall be interpretedto repeal or affect the validity of any rule filed or adopted prior toAugust 28, 1998, if it fully complied with the provisions of chapter 536,RSMo. Sections 166.400 to 166.455 and chapter 536, RSMo, are nonseverableand if any of the powers vested with the general assembly pursuant tochapter 536, RSMo, to review, to delay the effective date or to disapproveand annul a rule are subsequently held unconstitutional, then the grant ofrulemaking authority and any rule proposed or adopted after August 28,1998, shall be invalid and void.
