Special district, procedure to establish.
162.825. Whenever there is presented to the state board ofeducation a petition signed by voters in each district in theproposed special district equal in number in each district tofive percent of the number of votes cast for school board membersin the last annual school election praying (a) that a specialschool district embracing the entire area described in thepetition be organized for the education and training ofhandicapped and severely handicapped children and for vocationaleducation purposes; and (b) that a proposal be submitted to thevoters of the proposed district for the organization of thespecial school district, the state board of education, unlesssection 162.835 applies, shall, within thirty days of the receiptof said petition, direct the board of education of each schooldistrict comprising the proposed special district to cause theproposal to be submitted to the voters in each such district atthe next municipal election or, if the next annual schoolelection is more than sixty days away, cause the proposal to besubmitted to the voters in each such district at a specialelection called in accordance with law on a date set by the stateboard of education. The election shall be conducted in eachschool district comprising the proposed special district in themanner provided by law for the conducting of school districtelections generally in sections 162.351 and 162.601, unless adifferent procedure is specifically provided in sections 162.670to 162.995.
