Election authority to conduct all elections--which authority,how determined.
115.023. 1. Except as provided in subsections 2 and 3 of thissection, each election authority shall conduct all public elections withinits jurisdiction.
2. When an election is to be conducted for a political subdivision orspecial district, and the political subdivision or special district islocated within the jurisdiction of more than one election authority, theelection authority of the jurisdiction with the greatest proportion of thepolitical subdivision's or special district's registered voters shall beresponsible for publishing any legal notice required in this chapter.
3. When an election is to be conducted for a political subdivision orspecial district, and the political subdivision or special district islocated within the jurisdiction of more than one election authority, theaffected election authorities may, by contract, authorize one of theirnumber to conduct the election for all or any part of the politicalsubdivision or special district. In any election conducted pursuant tothis subsection, the election authority conducting part of an election inan area outside its jurisdiction may consolidate precincts acrossjurisdiction lines and shall have all powers and duties granted pursuant tothis chapter, except the provisions of sections 115.133 to 115.223 andsections 115.279 and 115.297, in the area outside its jurisdiction.
4. Notwithstanding the provision of section 493.030, RSMo, wheneverthe publication of a legal advertisement, legal notice, order of court orpublic notice of any kind is allowed or required pursuant to this chapter,a newspaper publishing such notice shall charge and receive not more thanits regular local classified advertising rate. The regular localclassified advertising rate is that rate shown by the newspaper's rateschedule as offered to the public, and shall have been in effect for atleast thirty days preceding publication of the particular notice to whichit is applied.
