Vacancies, how filled.
105.030. Whenever any vacancy, caused in any manner or byany means whatsoever, occurs or exists in any state or countyoffice originally filled by election of the people, other thanin the offices of lieutenant governor, state senator orrepresentative, sheriff, or recorder of deeds in the city of St.Louis, the vacancy shall be filled by appointment by thegovernor except that when a vacancy occurs in the office ofcounty assessor after a general election at which a person otherthan the incumbent has been elected, the person so elected shallbe appointed to fill the remainder of the unexpired term; andthe person appointed after duly qualifying and entering upon thedischarge of his duties under the appointment shall continue inoffice until the first Monday in January next following thefirst ensuing general election, at which general election aperson shall be elected to fill the unexpired portion of theterm, or for the ensuing regular term, as the case may be, andthe person so elected shall enter upon the discharge of theduties of the office the first Monday in January next followinghis election, except that when the term to be filled begins onany day other than the first Monday in January, the appointee ofthe governor shall be entitled to hold the office until suchother date. This section shall not apply to vacancies in countyoffices in any county which has adopted a charter for its owngovernment under section 18, article VI of the constitution.Any vacancy in the office of recorder of deeds in the city ofSt. Louis shall be filled by appointment by the mayor of thatcity.
