99.051. 1. Notwithstanding any conflicting provisions ofsection 99.050, in cities not within a county the followingprovisions shall govern the composition of the housing authoritycommission and the selection of the members thereof:
(1) Appointive members of the housing authority commissionshall be appointed by the mayor subject to the approval of thegoverning body of the city;
(2) Within one hundred days of the date the term of twoappointed members is to expire, and every fourth year thereafter,an election shall be conducted by the housing authoritycommission, after ten days' written notice to each tenant of thehousing authority, to elect from among the tenants in goodstanding of the housing authority two housing authoritycommissioners in addition to the five appointed members. Theelection shall be by written ballot and each tenant of thehousing authority who has attained the age of eighteen yearsshall be entitled to one vote. The two persons, tenants of thehousing authority, receiving the two highest numbers of votescast at the election shall be elected to terms of four years anduntil their successors are elected and qualified. The electivemembers of the commission, in addition to being tenants in goodstanding of the housing authority, shall possess the otherqualifications required for the office by the provisions ofsections 99.010 to 99.230, and shall not be employed in anycapacity by the authority.
2. Commissioners of the housing authority required by thissection to be tenants of the housing authority shall not beconstrued, because of such tenancy, to have a direct or indirectinterest in any housing authority project, or in any propertyincluded or planned to be included in any project, or in anyproposed contract for materials or services within the meaning ofsection 99.060.
3. Any commissioner required by provisions of this sectionto be a tenant of the housing authority who ceases to be suchshall thereby forfeit his office. In the event a tenantcommissioner forfeits his office, a special election shall beheld for the purpose of filling the vacancy. The election shallbe conducted according to the procedures specified in subdivision(2) of subsection 1 of this section governing the conduct ofregular elections of tenant commissioners. The successor electedat a special election shall serve only the remaining term of hispredecessor.
