Municipalities--power to acquire lands and other property, limitation.
91.770. Any municipality as herein defined shall have powerto purchase, lease or condemn lands or other property, orinterests therein, in the name of the state, necessary and properto enable it to carry out the purposes of sections 91.620 to91.770. If condemnation becomes necessary, the municipalitiesshall have power to proceed to condemn such lands or otherproperty, or interests therein, in the name of the state, inaccordance with the provisions of law relating to condemnationproceedings by railroad corporations insofar as same areapplicable; provided, however, that any municipality shall havepower to require any publicly or privately owned water system orsewer system service which is now or may hereafter be authorizedor ordered by the public service commission only by contract withthe owner thereof and with the approval of the public servicecommission, and the provisions of sections 91.620 to 91.770 shallnot be construed to authorize any such municipality to acquire,by condemnation proceedings, any such water system or sewersystem service, or any other public utility service, now orhereafter authorized or ordered by the public service commission.
