Condemnation of private property.
88.010. Whenever the city council, or the proper legislativebody of any city, shall deem it necessary to condemn orappropriate private property and to assess the cost thereofagainst property in a benefit district, said legislative bodyshall enact an ordinance setting forth the general nature orpurpose of the use to which such private property is to be putand declare it to be necessary to take and appropriate privateproperty therein described for such purpose and define the limitsof a benefit district within which private property shall bedeemed benefited or assessed to pay for such improvements, andthe time and mode of payment of such assessment and the penaltyfor failure to pay the same when due.
