78.040. Every city having a population of eight thousandand less than thirty thousand shall be governed by a councilconsisting of the mayor and four councilmen, and every cityhaving a population of three thousand and less than eightthousand shall be governed by a council consisting of the mayorand two councilmen, chosen as provided in sections 78.010 to78.420, each of whom shall have the right to vote on allquestions coming before the council. In cities having fourcouncilmen, three members of the council shall constitute aquorum, and in cities having two councilmen two members of thecouncil shall constitute a quorum, and in cities having fourcouncilmen the affirmative vote of three members, and in citieshaving two councilmen the affirmative vote of two members of thecouncil shall be necessary to adopt any motion, resolution orordinance, or pass any measure unless a greater number isprovided for in said sections. Upon every vote the yeas and naysshall be called and recorded, and every motion, resolution orordinance shall be reduced to writing and read before the vote istaken thereon. The mayor shall preside at all meetings of thecouncil; he shall have no power to veto any measure, but everyresolution or ordinance passed by the council must be signed bythe mayor, or by two councilmen, and be recorded, before the sameshall be in force.
