36.180. 1. The standards of education or experience in theclassification plan for each class shall be established on the basis ofspecified knowledge, skills and abilities. Admission to examinations shallbe open to all persons who possess the qualifications and who may belawfully appointed to a position in the class for which a register is to beestablished. The regulations may also require that applicants achieve atleast a satisfactory grade in each progressive part of the examination inorder to be admitted to subsequent parts of the examination or to receive afinal passing score.
2. To ensure competitive equality between the hearing impaired or theblind and persons not so disabled, the applicant may request from thedirector the furnishing of a certified interpreter for the hearing impairedor an amanuensis or a reader for the blind when necessary, and thefurnishing of a place to take such examination, or such other similarprerequisites to ensure equality in such examination.
3. The director may reject the application of any person foradmission to an examination, strike the name of any person from theregister, refuse to certify the name of any person, or withdraw thecertification of a person if the director finds that the person lacks anyof the qualifications, has been convicted of a crime which raises questionsabout his or her qualifications, has been dismissed from the public servicefor delinquency, has made a false statement of a material fact or practicedor attempted to practice any fraud or deception, in his or her applicationor examination or in attempting to secure appointment.
4. The director may take such action as is authorized in subsection 3of this section if the director finds the person has a health condition ordisability which would clearly prohibit the person from performing theduties required for the position for which the applicant has applied.
