§ 37-23-197. Eligibility for instruction in Braille reading and writing; determination of need for Braille instruction or use.
Each blind student shall be eligible for instruction in Braille reading and writing which will sufficiently enable that student to communicate effectively and efficiently with the same level of proficiency expected of the student's peers of comparable ability and grade level. If a decision is made by the IEP or 504 Team under Section 37-23-195 that Braille instruction or the use of Braille is required for the student, then the student's IEP or 504 Plan must be written in consultation with a Certified Teacher of the Visually Impaired. If a decision is made by the IEP or 504 Team that Braille instruction or the use of Braille is not required for the student, then the plan must include a statement that the decision was reached after an evaluation of the student's reading and writing skills, needs and appropriate reading and writing media, such as a learning media assessment or functional vision evaluation, including an evaluation of the student's future needs for instruction in Braille or the use of Braille.
