500.2059 Maintaining or operating office for transaction of insurance business; using name of insurer in conducting or advertising business not related to business of insurance.

Sec. 2059.

(1) No person shall maintain or operate any office in this state for the transaction of the business of insurance, except as provided for in this code, or use the name of any insurer, fictitious or otherwise, in conducting or advertising any business not related or connected with the business of insurance as governed by the provisions of this code except as otherwise provided in subsection (2).

(2) Subsection (1) shall not be construed to prohibit an agent licensed under chapter 12 from marketing or transacting any of the following:

(a) Subject to the health benefit agent act, health care coverage provided by a health care corporation regulated pursuant to the nonprofit health care corporation reform act, Act No. 350 of the Public Acts of 1980, being sections 550.1101 to 550.1704 of the Michigan Compiled Laws.

(b) Subject to the health benefit agent act, health care coverage provided by a health maintenance organization regulated pursuant to part 210 of the public health code, Act No. 368 of the Public Acts of 1978, being sections 333.21001 to 333.21098 of the Michigan Compiled Laws.

(c) Subject to the health benefit agent act, dental care coverage provided by a dental care corporation regulated pursuant to Act No. 125 of the Public Acts of 1963, being sections 550.351 to 550.373 of the Michigan Compiled Laws.

(d) Administrative services of a third party administrator regulated pursuant to the third party administrator act, Act No. 218 of the Public Acts of 1984, being sections 550.901 to 550.962 of the Michigan Compiled Laws.
