324.21314a Classification system.
Sec. 21314a.
The department shall establish and implement a classification system for sites considering impacts on public health, safety, and welfare, and the environment. Notwithstanding any other provision in this part, at sites posing an imminent risk to the public health, safety, or welfare, or the environment, corrective action shall be implemented immediately. If the department determines that no imminent risk to the public health, safety, or welfare, or the environment exists at a site, the department may allow corrective action at these sites to be conducted on a schedule approved by the department. This provision shall not be used by the department to limit the ability of a owner, operator or a consultant to submit a claim to the Michigan underground storage tank financial assurance fund, or delay payment on a valid claim to an owner, operator or consultant.
