§ 11-320. Citizenship and residency requirements for employees.
 

(a)  Scope of section.- This section does not apply to employees of trainers, owners, or concessionaires, or of other employers who are not licensees. 

(b)  85% minimum.-  

(1) Subject to subsection (c) of this section, at least 85% of the individuals employed each day by a licensee shall be citizens of the United States who have maintained a permanent place of residence in the State for at least the 2 years immediately before being employed. 

(2) Before the start of employment, each individual shall submit to the licensee who will employ the individual an affidavit that sets forth the qualifications required under this section. 

(3) The licensee may rely on the affidavit. 

(c)  Exclusions.- Clockers, heads of departments, and governing and managing officials of a track may be nonresidents of the State and are excluded from the residency computation under subsection (b) of this section.
