Notwithstanding any other provisions contained in this chapter, a certificate of need shall <br>not be required for an existing intermediate care facility for the mentally retarded <br>(ICF/MR) to add beds which shall be dedicated to providing respite services to <br>individuals with an ICF/MR level of care for no more than thirty (30) days. The <br>establishment of ICF/MR respite beds shall be limited to three (3) beds per fifty (50) <br>ICF/MR beds in a facility and shall not be eligible for Medicaid certification. Beds <br>designated for respite services under this section shall comply with all applicable federal <br>and state licensure requirements for intermediate care facilities for the mentally retarded.
