212.060 When fiscal court may not establish. When a county by a vote of its citizens, as provided in KRS 212.070 to 212.110, shall <br>vote against creating, establishing and maintaining a county department of health, the <br>department of health may not be created, established or maintained by resolution of its <br>fiscal court until after the expiration of the terms of office of the members of the fiscal <br>court who were members of the court when the election was held.
