to or make contracts with institutions, facilities, or organizations under
cabinet's control if conflict of interest involved. (1) No officer, employee, or agent of the Cabinet for Health and Family Services, a regional community mental health-mental retardation board or a nonprofit
corporation administering a regional community mental health-mental retardation
program shall sell anything to any institution, facility, or organization under the
control of the cabinet nor participate in selection, or in the award or administration
of a contract supported by state or federal funds if a conflict of interest, real or
apparent, would be involved. (2) Such a conflict of interest would arise when: (a) The employee, officer, or agent;
(b) Any member of his immediate family;
(c) His or her partner; or
(d) An organization which employs, or is about to employ, any of the above, has a financial or other interest in the firm selected for award. Effective: June 20, 2005
