95.850 Disability, medical, and hospital benefits for members of police and fire departments. (1) The legislative bodies of cities of the third and fourth classes may, in their discretion, pay unto any member of the police or fire departments, in case he is <br>disabled from an injury received while acting in his official capacity and in the line <br>of duty to such an extent as he is unable to execute the duties of his official capacity <br>or pursue a gainful occupation for which he is fitted by training or experience, <br>monthly compensation benefits equal to the member's monthly earnings at the time <br>of his injury, so long as his disability continues, but in no event shall the total <br>amount paid as compensation benefits to any member exceed the sum of five <br>thousand dollars (&#36;5,000). (2) The legislative bodies of cities of the third and fourth classes may, in their discretion, in addition to the compensation benefits provided for in subsection (1), <br>pay the member's medical and hospital expenses, but in no event shall the payments <br>therefor exceed the sum of one thousand dollars (&#36;1,000). (3) The testimony of competent medical authorities shall be the sole test as to whether any member is disabled to the extent provided for in subsection (1). (4) This section is not applicable in any city of the third or fourth class which has in operation, pursuant to statute, a pension system for policemen and firefighters, <br>under which disability benefits are payable.
