77.275 Continuation of variances granted by prior ordinance. If any local ordinance has provided regulations similar to those in KRS 77.150 to 77.175 <br>or to any order, regulation, or rule prescribed by the air pollution control board, and has <br>provided for the granting of variances, and pursuant to the local ordinance a variance has <br>been granted prior to the adoption of a resolution by the fiscal court and the passage of an <br>ordinance by the legislative body of a city of the first or second class, pursuant to KRS <br>77.010 to 77.060, or the passage of an ordinance by the consolidated local government, <br>the variance shall be continued as a variance of the hearing board for the time specified <br>therein or one (1) year, whichever is shorter, or until and unless prior to the expiration of <br>such time the hearing board modifies or revokes such variance as provided in KRS <br>77.245 to 77.275.
