72-8236. Child care facilities; authority to establish, operate, andmaintain; fees, collection and disposition.(a) The board of education of any school district may: (1)Establish, operate and maintain a child care facility; (2) enter intocooperative or interlocal agreements with one or more other boards for theestablishment, operation and maintenance of a child care facility; (3)contract with private, nonprofit corporations or associations or with anypublic or private agency or institution, whether located within or outside thestate, for the establishment, operation and maintenance of a child carefacility; and (4) prescribe and collect fees for providing care at achild care facility.
(b) Fees for providing care at a child care facility establishedunder authority of this section shall be prescribed and collected only torecover the costs incurred as a result of and directly attributable to theestablishment, operation and maintenance of the child care facility. Revenuesfromfees collected by a board under this section shall be deposited in the generalfund of the school district and shall be considered reimbursements to thedistrict for the purpose of the school district finance and quality performanceact and may be expended whether the same have been budgeted or not and amountsso expended shall not be considered operating expenses.
(c) Every school district which establishes, operates and maintains achild care facility shall be subject to the provisionscontained in article 5 of chapter 65 of Kansas Statutes Annotated.
(d) As used in this section, the term "child" means any child who isthree years of age or older, and any infant or toddler whose parent or parentsare pupils or employees of a school district which establishes, operates andmaintains, or cooperates in the establishment, operation and maintenance of, achild care facility under authority of this act.
