72-5524. Limitation of actions to recover refund or installment;qualifying conditions.In case no claim or suit is filed for the recovery of any refund orannuity installment due under the provisions of this act within fiveyears after the same is due and payable, the amount of any such refundor annuity installment due and payable from the school employees savingsfund shall be transferred to the state school service annuity fund:Provided, If any such person shall present satisfactory evidence tothe board that his failure to file such application within said timeperiod was due to lack of knowledge or incapacity on his part, the totalamount originally due shall be paid such person from the state schoolservice annuity fund.
