Article 4.--RESIDENCE DETERMINATION

      71-407.   Same; certain persons considered state residents; definitions;eligibility criteria.(a) The following persons, or any class or classes thereof,and their spouses and dependents, may be considered residents of the state ofKansas by the state board for the purpose of determining stateentitlementsof community colleges:(1) Persons who are in active military serviceof the United States; (2) persons who are domiciliary residents of the state,who were in active military service prior to becoming domiciliary residents ofthe state, who were present in the state for a period of not less than twoyears during their tenure in active military service, whose domiciliaryresidence was established in the state within 30 days of discharge orretirement from active military service under honorable conditions, but whosedomiciliary residence was not timely enough established to meet the residenceduration requirement of K.S.A. 71-406, and amendments thereto; (3) persons whoare employees of a community college; (4) persons having special domesticrelations circumstances; (5) persons who have lost their resident status withinsix months of enrollment; (6) persons who are not domiciliary residents of thestate, who have graduated from a high school accredited by the state board ofeducation within six months of enrollment at a community college, who weredomiciliary residents of the state at the time of graduation from high schoolor within 12 months prior to graduation from high school, and who are entitledto admission at a state educational institution pursuant to K.S.A. 72-116, andamendments thereto; and (7) persons who are domiciliary residents of the state,whose domiciliary residence was established in the state for the purpose ofaccepting, upon recruitment by an employer, or retaining, upon transferrequired by an employer, a position of full-time employment at a place ofemployment in Kansas, but the domiciliary residence of whom was not timelyenough established to meet the residence duration requirement of K.S.A. 71-406,and amendments thereto.

      (b)   As used in this section:

      (1)   "Domiciliary resident" means a person who has present and fixedresidence in Kansas where the person intends to remain for an indefiniteperiod and to which the person intends to return following absence.

      (2)   "Full-time employment" means employment requiring at least 1,500hours of work per year.

      (c)   The state board shall prescribe criteria and guidelines fordeterminationof the eligibility of persons specified insubsection (a) to be considered residents of the stateand shall specify the evidencenecessary to be submitted by such persons as proof ofeligibility. Evidence submitted by a person as proof of eligibility claimedunder subsection (a)(7) must include, but not byway of limitation,certification of the claim by the employer of the person.
