70a-108. Same; penalty for violations; evidence.Any person or corporation violating any provision of this act shall beguilty of a misdemeanor and upon conviction shall be punished by a fine ofnot less than twenty-five dollars nor more than one thousand dollars, or byimprisonment in the county jail for not more than six months or by bothsuch fine and imprisonment; and for purposes of prosecution it shall beprima facie proof that the river bed or island involved in such suit is theproperty of the state to show by the records of the county clerk andregister of deeds that the same is not recorded as patented by the UnitedStates or by the state of Kansas or recorded as school land sold but notyet patented by the state of Kansas, or otherwise held by record title.
