68-2070. Definitions.As used in this act, the following words and terms shall have thefollowing meanings, unless the context shall indicate another or differentmeaning or intent:
(a) The word "authority" shall mean the Kansas turnpike authority.
(b) The word "project" or the words "highway project" shall mean anymodern express highways in the state of Kansas financed and constructedunder the provisions of this act by the authority, including all bridges,tunnels, overpasses, underpasses, interchanges, entrance plazas,approaches, toll houses, service stations, and administration, storage andother buildings and facilities which the authority may deem necessary forthe operation of such project, together with all property, rights,easements, and interests which may be acquired by the authority for theconstruction or the operation of such project.
(c) The word "cost" as applied to any highway project or projects shallembrace the cost of construction, the cost of the acquisition of all land,rights-of-way, property, rights, easements and interests acquired by theauthority for such construction, and the cost of demolishing or removingany buildings or structures on land so acquired, including the cost ofacquiring any lands to which such buildings or structures may be moved, thecost of all machinery and equipment, financing charges, interest prior toand during construction, and, if deemed advisable by the authority, for aperiod of not exceeding two (2) years after completion of construction, thefunding of a debt service reserve not in excess of two (2) years intereston the bonds, cost of traffic estimates and of engineering and legalservices, plans, specifications, surveys, estimates of costs and ofrevenues, other expenses necessary or incident to determining thefeasibility or practicability of constructing any such project,administrative expense, and such other expenses as may be necessary orincident to the construction of any project or projects, the financing ofsuch construction and the placing of any project or projects in operation.The word "cost" may also include amounts to be used by the authority forpaying fees and expenses of engineers for making traffic studies, surveysand estimates of cost and of revenues, legal fees and expenses whether thesame have been heretofore incurred and other expenses necessary or incidentto determining the feasibility or practicability of constructing anyadditional highway project or projects. Any obligation or expensehereinbefore or hereafter incurred by the secretary of transportation withthe approval of the authority for traffic surveys, borings, preparation ofplans and specifications, and other engineering services in connection withthe construction of any project shall be regarded as a part of the cost ofsuch project and shall be reimbursed to the secretary of transportation outof the proceeds of such highway revenue bonds hereinafter authorized.
(d) The words "public highways" shall include all public highways, roadsand streets in the state, whether maintained by the state or by any county,city, township or other political subdivision.
(e) The word "bonds" or the words "highway revenue bonds" shall mean therevenue bonds of the authority authorized under the provisions of this act.
(f) The word "owner" shall include all individuals, copartnerships,associations or corporations having any title or interest in any property,rights, easements or interests authorized to be acquired by this act.
