65-3460. Voluntary local hazardous waste programs; duties of thesecretary; rules and regulations; reports.(a) In order to (1) provide for the safe disposal of smallquantities of hazardous waste in the possession of homeowners,householders, farmers and exempt small quantity hazardous wastegenerators in amounts not exceeding the amount prescribed in K.S.A. 65-3451 andamendments thereto; (2) educate thepublic about the dangers posed by hazardous waste; and (3) encourage localunitsof government to develop local hazardous waste collection programs eitherindividually or jointly, the secretary of health and environment maycoordinate voluntary hazardous waste collection programs toensure the safe collection and disposal of such waste.
(b) The secretary of health and environment may adopt rules andregulations for conducting both hazardous temporary and permanent wastecollection programs.The secretary shall supervise the program and ensure that the local unit ofgovernment contracts with a bonded waste handling company approved by thesecretary for implementation of the program.
(c) The secretary of health and environment may receive moneys for useas grants to help defraythe expense of operating hazardous waste collection programs.Any money received to defray the cost of the programs shall be deposited inthe state treasury and credited to the hazardous waste collection fund,which is hereby created. Costs and expenses arising from the implementationof this section shall be paid from such fund.
(d) Not later than the first day of each legislative session, thesecretary of health and environment shall submit to the speaker of thehouse of representatives and the president of the senate a report on hazardouswaste collection programs carried out under this section during the precedingcalendar year.
