65-3424a. Restrictions on disposal.No person shall:
(a) Maintain an illegal waste tire accumulation;
(b) transferownership of waste tires to any person unless the recipient: (1) Has beenissued a permit by the secretary pursuant to K.S.A. 65-3407, and amendmentsthereto, or K.S.A. 65-3424b, and amendments thereto; (2) intends to use thewaste tires for a beneficial use; or (3) is a tire retailer who collects wastetires from the public or other tire retailers in the ordinary course ofbusiness;
(c) deposit waste tires in a landfill as a method ofultimate disposal, except that the secretary may authorize, by rules andregulations or by permits issued pursuant to K.S.A. 65-3407, and amendmentsthereto: (A) The final disposal of processed waste tires at permitted municipalsolid waste landfills and permitted waste tire monofills; (B) the finaldisposal of contaminated whole, unprocessed waste tires at permitted municipalsolid waste landfills and permitted waste tire monofills; (C) the use of wastetires in their original state as part of or supplemental to a proven andapproved leachate collection system at a landfill; (D) the use ofwastetires which have been cut into two or more parts as daily cover material for alandfill; or(E) the final disposal of small numbers ofwhole, unprocessed waste tires in landfills if such tires are intermingled withother solid waste and retrieval of such tires would be hazardous; or
(d) receive money in exchange for waste tires unless: (A)The person holds a permit issued by the secretary pursuant to K.S.A. 65-3407or 65-3424b, and amendmentsthereto; or (B) the person is a tire retailer who collects waste tires from thepublic or from other tire retailers in the ordinary course of business.
