65-1828. Penalty for violations; enforcement of act and sanitationstandards; procedure.(a) A violation of any provision of this act, except as otherwiseexpressly provided by this act, is a misdemeanor punishable by afine of not less than $25 or by imprisonment notexceeding six months, or both, and each day during which such violationcontinues shall be deemed a separate violation.
(b) The board mayinstitute such actions in the courts of competent jurisdiction as mayappear necessary to enforce compliance with any provision of this act.
(c) The board may obtain enforcement of its rules and regulations orany subpoena or other order of the board in accordance with the act forjudicial review and civil enforcement of agency actions and may obtainenforcement of any sanitation standards adopted by the secretary of healthand environment pursuant to K.S.A. 65-1,148 as if such standards were rules andregulations of the board.
