65-16,104. Same; confidential information;authorized access to data in the log.(a) Methamphetamine precursor recording loginformation submitted to the board shall be confidential and nota public record and notsubject to the Kansas open records act, K.S.A. 45-215 et seq., and amendmentsthereto, except as provided in subsections (c) and (d).
(b) The board shall maintain procedures to ensure that theprivacy and confidentiality of information collected, recorded,transmitted and maintained is not disclosed to persons except asprovided in subsections (c) and (d).
(c) The board shall be authorized to provide data in the logto the following persons:
(1) Any person authorized to prescribe or dispense productscontaining pseudoephedrine, ephedrine or phenylpropanolamine, forthe purpose of complying with the provisions of this act; and
(2) local, state and federal law enforcement orprosecutorial officials.
(d) The board may provide data to public or private entitiesfor statistical, research or educational purposes after removinginformation that could be used to identify individual patients orpersons who received methamphetamine precursors from pharmacies.
