Article 11.--REGULATION OF NURSING

      65-1130.   Advanced registered nurse practitioner;standards and requirementsfor obtaining certificate of qualification; rules and regulations; categories,education, qualifications and role;limitations and restrictions; prescription of drugs authorized.(a) No professional nurse shall announce or represent to the public thatsuch person is an advanced registered nurse practitioner unless suchprofessional nurse has complied with requirements established by the boardand holds a valid certificate of qualification as an advanced registerednurse practitioner in accordance with the provisions of this section.

      (b)   The board shall establish standards and requirements for anyprofessional nurse who desires to obtain a certificate of qualification asan advanced registered nurse practitioner. Such standards and requirementsshall include, but not be limited to, standards and requirements relatingto the education of advanced registered nursepractitioners.The board may require that some, but not all, types of advanced registerednurse practitioners hold an academic degree beyond the minimum educationalrequirement for qualifying for a license to practice as a professionalnurse. The board may give such examinations and secure such assistance asit deems necessary to determine the qualifications of applicants.

      (c)   The board shall adopt rules and regulations applicable to advancedregistered nurse practitioners which:

      (1)   Establish categories of advanced registered nurse practitioners whichare consistent with nursing practice specialties recognized by the nursingprofession.

      (2)   Establish education and qualifications necessary forcertificationfor each category of advanced registered nurse practitioner establishedby the board at a level adequate to assure the competent performance byadvanced registered nurse practitioners of functions and procedures whichadvanced registered nurse practitioners are authorized to perform.

      (3)   Define the role of advanced registered nursepractitionersand establish limitations and restrictions on suchrole. Theboardshall adopt a definition of the role under thissubsection (c)(3)whichis consistent with the education and qualifications requiredtoobtain a certificate of qualification as an advanced registered nursepractitioner,which protects the public from persons performing functions and proceduresas advanced registered nurse practitioners for which they lack adequateeducation and qualifications and which authorizes advancedregisterednurse practitioners to perform acts generally recognized by the professionof nursing as capable of being performed, in a manner consistent with thepublic health and safety, by persons with postbasic education in nursing.In defining such role the board shall consider: (A) Theeducation required for a certificate of qualification as an advancedregistered nurse practitioner; (B) the type of nursing practice and preparationin specialized practitioner skills involved in each category of advancedregistered nurse practitioner established by the board; (C) the scope ofpractice of nursing specialties and limitations thereon prescribed by nationalorganizations which certify nursing specialties; and (D) acts recognized bythe nursing profession as appropriate to be performed by persons withpostbasic education in nursing.

      (d)   An advanced registered nurse practitioner may prescribe drugspursuant to a written protocol asauthorized by a responsible physician. Each written protocol shall containa precise and detailed medical plan of carefor each classification of disease or injury for which theadvanced registered nurse practitioner is authorized to prescribe andshall specifyall drugs whichmay be prescribed by the advanced registered nursepractitioner.Any written prescription order shall include the name, address and telephonenumber of the responsible physician.The advanced registered nurse practitioner may not dispensedrugs, but may request, receive and sign for professional samples and maydistributeprofessional samples to patients pursuant to a written protocol as authorizedbya responsible physician. In order to prescribe controlled substances,the advanced registered nurse practitioner shall (1) register with the federaldrug enforcement administration; and (2) notify the board of the name andaddress of the responsible physician or physicians. In nocase shall the scope of authority of the advanced registered nursepractitioner exceed the normal and customary practice of the responsiblephysician.Anadvanced registered nurse practitioner certified in the category ofregistered nurse anesthetist while functioning as a registered nurseanesthetist under K.S.A. 65-1151 to 65-1164, inclusive, andamendments thereto, shall be subject to the provisions of K.S.A.65-1151 to 65-1164, inclusive, and amendments thereto, with respect todrugs and anesthetic agents and shall not be subjectto theprovisions of this subsection.For the purposes of this subsection, "responsible physician"means a person licensed to practice medicine and surgery in Kansas whohas acceptedresponsibility for the protocol and the actions of the advanced registerednurse practitionerwhen prescribing drugs.

      (e)   As used in this section, "drug" means those articles and substancesdefined as drugs in K.S.A. 65-1626 and 65-4101 and amendmentsthereto.
