61-4001. Court fees; authorized only by legislativeenactment; poverty affidavit.(a) Docketfee. No case shall be filed or docketed pursuant tothe code of civil procedure for limited actions without the paymentof a docket fee in the amount of $37 on and after July 1,2009 through June 30, 2013, and $35 onandafter July 1, 2013, if the amount in controversy orclaimed does notexceed $500; $57 on and after July 1, 2009through June 30, 2013, and $55 on and after July 1,2013, ifthe amount in controversy or claimed exceeds $500 butdoes not exceed$5,000; or $103 on and after July 1, 2009through June 30, 2013, and $101 on and after July 1,2013, ifthe amount in controversy or claimedexceeds $5,000. Ifjudgment isrendered for the plaintiff, the court also may enter judgment for the plaintifffor the amountof the docket fee paid by the plaintiff.
(b) Poverty affidavit; additional court costs; exemptions for thestate and municipalities. The provisions of subsections(b), (c) and (d) ofK.S.A. 60-2001 and 60-2005 and amendments thereto, shall be applicableto lawsuits broughtunder the code of civil procedure for limited actions.
(c) Except as provided further, the docket fee established in thissectionshall be the only fee collected or moneys in the nature of a fee collected forthe docket fee. Such fee shall only be established by an act of the legislatureand no other authority is established by law or otherwise to collect a fee.On andafter July 1, 2009 through June 30, 2010, the supreme court may impose anadditional charge, not to exceed $10 per docketfee, to fund thecostsofnon-judicial personnel.
